2. Scope of the Agreement

These Terms govern the purchase and use of:
– digital downloads (toolkits, presets, samples, templates, Max for Live devices)
– online courses
– membership areas
– audio production tools, resources, and educational materials

By completing a purchase, you agree to these Terms.


3. Prices and Payment

– All prices are stated in EUR and include VAT where applicable.
– Payment is due immediately at checkout.
– Payments are processed via third-party payment providers (e.g., Stripe, PayPal).
– Access to digital products is granted immediately after successful payment.


4. Delivery of Digital Products

– Digital content is delivered instantly via download or via access inside your Kajabi account.
– You are responsible for ensuring that your device, software, and internet connection support the product (e.g., Ableton version, plugin requirements, etc.).
– If any technical issues occur, contact support at the email above.


5. No Right of Withdrawal (Digital Content)

By purchasing, you expressly agree that:

1. the digital product will be delivered immediately, before the withdrawal period expires, and
2. you lose your legal right of withdrawal once access or download begins.

This follows EU law for digital content.

No refunds can be issued after access is granted.


6. Licensing & Usage Rights

Unless explicitly stated otherwise, you receive a non-exclusive, non-transferable license to use the purchased content for your own private and commercial music production.

You may not:
– resell, share, upload, or distribute the products
– make the products available to third parties
– use the content in your own products, courses, preset packs, or templates
– reverse-engineer, modify, or extract code from Max for Live devices
– allow others to use your downloads or login credentials

You may:
– use the content for your personal and commercial music releases
– use templates as starting points for your own productions

All intellectual property remains with the provider.


7. Course / Membership Access

– Access is personal and may not be shared.
– Duration of access is stated on the product page (lifetime access unless noted otherwise).
– Accounts may be suspended for abuse, sharing access, or violating these Terms.


8. Updates

Updates or improvements to digital products may be provided but are not guaranteed unless explicitly stated in the product description.


9. Liability

To the maximum extent permitted by law:
– No guarantee is made for specific results, improvements, or outcomes in music production.
– You are responsible for your own system setup, backups, software compatibility, and working environment.
– The provider is not liable for data loss, system issues, or incompatibility.
– Liability for slight negligence is excluded.

This does not affect liability for intent, gross negligence, or personal injury.

Support will be provided within a reasonable timeframe (usually within 48 hours).


11. Prohibited Behavior

You agree not to:
– share or distribute purchased content
– grant others access to your account
– misuse download links or access data
– violate copyright or licensing terms
– circumvent any protection mechanisms

Violations may result in account suspension and legal action.


12. Changes to These Terms

The provider may update these Terms from time to time.
The version in place at the time of purchase applies to that purchase.


13. Governing Law

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
